Namahaom.com provides a platform for users to access religious services, including homams, pujas, astrology consultations, vaastu consultations, and associated products. • Religious rituals such as homas, yagnas, pujas, and prasad offerings.

• Sale of religious products including pooja Samagiri.

3. Charges and Payments

Fees for services, products, and consultations are specified on the Website and/or the App and must be paid in full at the time of booking or purchase. Prices may be subject to change without prior notice, and the charges will be inclusive of taxes and applicable costs unless otherwise stated.

4. Product and Service Specifications

Religious Services: The cost of pujas, homams, and other rituals includes materials, labor, and associated charges. Services will be performed as per the requested schedule, and any deviations (such as delays due to external factors like weather, traffic, or health issues) are not within our control.

You may access the Website and App only for lawful purposes and in accordance with these Terms.
You are prohibited from using the Website or App in any way that could harm, disrupt, or interfere with the functionality or the experience of other users.

If arbitration is not effective, disputes may be submitted to the courts located in Chennai, Tamil Nadu, India. You agree to submit to the exclusive jurisdiction of these courts.

13. Indemnification

You agree to protect, defend, and release Namahaom.com, including its affiliates, officers, employees, and agents, from any claims, damages, losses, liabilities, or expenses (including legal fees) that may arise due to your use of the Website, App, or Services, your breach of these Terms, or any violation of third-party rights.

14. Termination of Services

Namahaom.com reserves the right to suspend or terminate your access to the Website, the App, and Services at any time, for any reason, including violations of these Terms. Upon termination, you must cease all use of the Website, the App, and Services.

15. Applicable Law and Jurisdiction

These Terms will be governed and construed in accordance with the laws of the Republic of India. Any dispute or legal matter arising under or connected to these Terms shall fall under the exclusive jurisdiction of the courts located in Delhi, India.

16. Miscellaneous Provisions

• Severability: If any provision of these Terms is found to be invalid or unenforceable, the remainder of the Terms will remain in full force and effect.

• Entire Agreement: These Terms constitute the entire agreement between you and Namahaom.com concerning the use of the Website, App, and Services and supersede any prior agreements or communications.

17. Force Majeure: Force Majeure:

Our services may be delayed or canceled under certain circumstances beyond our control, including but not limited to: floods, high traffic (e.g., during festivals), heavy rainfall, curfews, interruptions in social security personnel (at the society or individual home level), disruption of internet or phone connectivity, or any other unforeseen events that may prevent us from reaching you or providing timely service.

18. Hospital Admission and Reassignment

If the hospital you have specified is unable to accept you or new patients at the time of emergency, we reserve the right to admit you to another nearby hospital to the best of our ability. We are not responsible for any consequences arising from the reassignment.

19. Scope of Responsibility

Our responsibility begins when we send a representative to your registered location and continues with arranging an ambulance, as per your chosen package or plan, to transport you to the hospital (either your specified hospital or an alternate hospital). Once you arrive at the hospital, the responsibility for your care will transfer to you, your family members, or your authorized representatives. We will not be responsible for any medical expenses, hospital bills, or other associated costs incurred thereafter

20. Alternative Transportation Arrangements

In the event that an ambulance is unavailable, we will make reasonable efforts to arrange an alternate means of transportation to the hospital. Any such costs will be borne by us.

21. Service Area

Our services are only available from your registered address with us. We will not provide services to any location outside of this address.

22. Death During Transport

In the unfortunate event of death occurring while in transit to the hospital, we shall not be held responsible or liable in any manner.

23. Police Involvement

If, based on the circumstances, we deem it necessary to involve law enforcement, we reserve the right to notify and cooperate with the police.

24. Representative Access

Our representatives are not direct employees of our company, but are hired through a third-party agency. Therefore, they are not authorized to enter your premises. If you choose to allow or invite a representative to enter your property, it will be entirely at your own risk. You are responsible for securing your belongings and valuables, and we will not be liable for any loss or damage in any circumstances.

25. Physical Violence

In situations involving physical violence or the threat of harm, we reserve the right to contact law enforcement as necessary.

26. Personal Belongings and Valuables

While being transported to the hospital, you, your family members, or any accompanying individuals are solely responsible for your personal belongings and valuables. We will not be held liable for any loss or damage to personal items under any circumstances.

28. Application Acceptance and Refunds

We reserve the right to accept or reject any application for service, and to refund the amount in full without any obligation to provide a reason. Any refunds will be subject to the terms outlined in Section 13, and the refund amount will be adjusted for payment gateway and banking transaction charges, if applicable.

29. Approval Time for Applications

Please allow up to 1-2 weeks for approval of your application, as we need to gather relevant information from hospitals, ambulance services, and law enforcement authorities.

30. Sharing of Medical and Insurance Information

We reserve the right to share your medical history and insurance details with the hospital, emergency medical services, and other relevant authorities as needed during an emergency.

31. Communication During Emergencies

We may contact your family members, friends, or relatives through phone calls, WhatsApp, SMS, or other means of communication during emergencies or urgent situations.

32. Refund Terms

The deposit amount received from panic support will be entirely refundable without any interest after deducting GST and filing charges.
